Damage and smoking policy
1. Guest responsibility
Guests must take reasonable care of the accommodation, furniture, appliances, equipment and other contents. Guests are responsible for damage caused by their intentional acts, negligence or misuse, including damage caused by people visiting them.
Guests must use the accommodation responsibly and comply with this policy and any other rules communicated before the booking is confirmed.
2. Strict no-smoking policy
Smoking is strictly prohibited throughout the accommodation. This includes cigarettes, cigars, pipes, electronic cigarettes, vaping devices and heated tobacco products.
Smoking is prohibited inside the apartment and in any indoor areas forming part of the accommodation. It is also prohibited on balconies and terraces belonging to the accommodation.
Guests must ensure that their visitors comply with this rule.
If smoking results in smoke odour, stains, burns, damage or the need for additional cleaning or deodorising beyond ordinary housekeeping, LexHome may seek compensation for the reasonable, documented costs directly resulting from the violation.
A breach of this rule may also be treated as a breach of the booking terms. Any further action, including ending a stay, must be taken in accordance with applicable law.
3. What counts as damage
Examples of damage include:
- Broken or damaged furniture, appliances, fixtures or household items.
- Burns, persistent smoke odour or stains requiring specialist cleaning.
- Excessive cleaning required because of misuse of the accommodation.
- Lost keys or damage to locks requiring repair or replacement.
- Other physical damage caused by the guest or their visitors.
Guests are not responsible under this policy for normal wear and tear, pre-existing damage, or issues not attributable to them.
4. Reporting damage
Guests should inform LexHome as soon as reasonably possible if something is damaged during their stay. Prompt reporting can help prevent further damage and allow repairs to be arranged.
5. Assessment and compensation
Where damage or a breach of the no-smoking policy occurs, LexHome will assess the circumstances and may seek compensation for the reasonable loss incurred.
Any claim will be based on the actual, reasonable and documented cost of cleaning, repair or replacement where repair is not reasonably possible. When assessing replacement costs, LexHome will take account of the item’s age, condition and value before the damage occurred.
Evidence may include photographs, invoices, repair estimates, cleaning invoices or replacement receipts. Compensation will not be charged automatically at an arbitrary fixed amount.
6. Opportunity to respond
Before requesting payment, LexHome will provide the guest with an explanation of the alleged damage or breach and the amount claimed, together with supporting evidence where reasonably available. The guest will be given a reasonable opportunity to respond.
7. Legal basis and disputes
This policy forms part of the booking terms when made available to the guest before the booking is confirmed and accepted as part of those terms.
Claims for damage may be assessed under the applicable provisions of Bulgarian law, including Article 233 of the Obligations and Contracts Act where applicable. The legal basis and extent of any claim will depend on the circumstances and the nature of the booking.
Nothing in this policy excludes or limits rights or obligations that cannot lawfully be excluded or limited. If a claim is disputed, the parties should seek to resolve it fairly, without prejudice to their legal rights.
8. No automatic penalties
LexHome does not impose an automatic fixed penalty solely because a rule has been breached. Any compensation sought must be reasonably connected to the loss or additional costs incurred and supported by appropriate evidence.
9. Acceptance
By confirming a booking, guests acknowledge that they have been given access to this policy and agree to comply with its terms, subject to applicable law.
